NYC Mayor Says City Lacks Authority to Arrest Netanyahu

New York City Mayor Zohran Mamdani acknowledged in late July that the city lacks independent legal authority to arrest Israeli Prime Minister Benjamin Netanyahu, despite earlier statements suggesting the possibility. Mamdani released a video message confirming that after consulting with city legal advisers, New York has no standalone power to enforce the International Criminal Court's arrest warrant against Netanyahu. He called on the federal government to take action instead.

Mamdani had stated in a July 18 New York Times interview that he was exploring whether the city could arrest Netanyahu if he attended the United Nations General Assembly in September. He characterized Netanyahu as "a war criminal charged by the International Criminal Court" and described him as "the architect of a horrific genocide against the Palestinian people." Mamdani said Netanyahu should face trial in The Hague for alleged war crimes and crimes against humanity related to Israel's military operations in Gaza. However, he acknowledged uncertainty about his authority to direct the New York Police Department to detain a foreign leader.

The ICC issued the arrest warrant against Netanyahu in 2024, alleging war crimes and crimes against humanity related to Israel's military operations in Gaza beginning October 8, 2023. The warrant cited allegations that Netanyahu and former Defense Minister Yoav Gallant used "starvation as a method of warfare" by restricting humanitarian aid and intentionally targeted civilians. Netanyahu has denied the allegations and rejected the ICC's jurisdiction. The United States is not a party to the ICC's founding treaty, the Rome Statute, and has no legal obligation to enforce ICC warrants.

President Donald Trump intervened on July 20–21, stating on social media that Netanyahu "will not be arrested in any way, shape, or form while in the United States of America." Israeli officials, including UN Ambassador Danny Danon, sharply criticized Mamdani's statements. Danon stated Mamdani was "elected to serve New Yorkers, not Hamas' propaganda," and Netanyahu's office characterized the ICC as a "kangaroo court." Netanyahu has previously stated that Mamdani's public statements represent efforts to undermine Israel's right to self-defense.

Mamdani's acknowledgment marked a significant shift from his 2025 mayoral campaign pledge to pursue Netanyahu's arrest. The dispute reflects broader changes in American political attitudes toward Israel: polling cited in reporting shows Democratic voter support for U.S. aid to Israel has declined significantly in recent years. However, the exchange also revealed tensions between Trump's defense of Netanyahu and Mamdani's progressive political coalition, which includes constituencies opposed to the Gaza military campaign. Netanyahu's expected September visit to New York for the UN General Assembly remains scheduled.
