Nigerian Court Dismisses Businesswoman's N10bn Damages Suit Against EFCC
A Federal High Court in Abuja dismissed a N10 billion damages suit filed by businesswoman Aisha Achimugu against the EFCC, ruling that the agency had legal authority to search her residence and seize her property based on intelligence about alleged criminal activities. The judge found the suit lacked merit and was brought in bad faith.
Quick Facts
- Federal High Court dismissed N10 billion fundamental rights suit
- EFCC searched Achimugu's residence and seized vehicles, jewellery, and belongings
- Court upheld EFCC's statutory authority to conduct search
- Court rejected damages claim
- Court ordered final forfeiture of N8.9 billion in assets

The Federal High Court in Abuja on October 12, 2026, dismissed a N10 billion fundamental rights suit filed by Abuja-based businesswoman Aisha Achimugu against the Economic and Financial Crimes Commission (EFCC). Justice Musa Liman ruled that the EFCC had statutory authority to search Achimugu's residence and seize her property—including vehicles, jewellery, and other belongings—after receiving intelligence about her alleged criminal activities.
In the suit marked FHC/ABJ/CS/466/2026, Achimugu had challenged the legality of the search and seizure, sought enforcement of her right to privacy, and demanded N10 billion in damages for what she described as an invasion of her private space. She also sought a court order restraining the EFCC from harassing or invading her residence. Justice Liman rejected all claims, finding that Achimugu and her legal representatives failed to establish grounds justifying the compensation sought. The judge described the suit as lacking merit, frivolous, and brought in bad faith.
EFCC counsel Emenike Mgbemele welcomed the ruling, describing it as serving the interests of justice and characterising the suit as an attempt to waste the court's time. The dismissal comes amid an ongoing EFCC investigation into Achimugu's financial dealings. In April 2025, a separate Federal High Court order had directed her to appear before the EFCC to answer questions about allegations including money laundering, conspiracy, obtaining money by false pretence, and corruption. The investigation also focuses on funds allegedly received by her company, Oceangate Engineering Oil and Gas Limited, in connection with oil block acquisitions.
In a related proceeding in July 2026, the Federal Capital Territory High Court ordered the final forfeiture of assets worth approximately N8.9 billion linked to Achimugu to the Federal Government. Justice Jude Onwugbuzie's forfeiture order covered jewellery valued at N4.65 billion, 11 exotic vehicles worth N4.29 billion, $50,000, and N30 million in cash. Achimugu has been the subject of multiple money laundering investigations and has been detained and interrogated by the EFCC over the allegations.
Why This Matters
The dismissal upholds law enforcement authority to conduct asset searches and seizures in financial crime investigations in Nigeria's judicial framework. It affects individuals and businesses under investigation for money laundering and financial crimes—establishing that courts will not award compensation for searches deemed statutory and intelligence-based. The ruling follows related asset forfeiture orders totaling approximately N8.9 billion, affecting the defendant's property holdings and potentially signaling judicial standards for similar cases involving allegations of financial misconduct.
