A U.S. federal judge temporarily blocked construction of President Trump's proposed 250-foot triumphal arch on November 6, just hours after the National Capital Planning Commission voted to approve the project. U.S. District Judge Tanya Chutkan issued a 14-day injunction, ruling that the Trump administration likely failed to follow required legal procedures and that Virginia and the District of Columbia have standing to sue based on potential "tangible economic harms" from traffic problems at the construction site.
The National Capital Planning Commission, which serves as the federal government's planning agency for the region, voted 8-4 to approve the arch after nearly 9 hours of public testimony. The structure is designed to stand 166 feet tall with three gilded figures on top, reaching 250 feet overall. It would be located between the Lincoln Memorial and Arlington National Cemetery in northern Virginia, near Ronald Reagan Washington National Airport. The Federal Aviation Administration determined the arch poses no hazard to air navigation with appropriate safety lighting.
Opposition to the project has come from Vietnam War veterans, Democratic lawmakers, and local officials who argue the arch's scale conflicts with the area's historic sightlines and memorial character. Marine veteran Jimi Shaughnessy testified that "a dominating arch with a carnival-like atmosphere of tourists, food trucks and buses is abhorrent and insulting to those who gave all." California Rep. Jared Huffman called the arch "illegal" and said it would "disrupt the solemn connection" between the Lincoln Memorial and Arlington National Cemetery. The Trump administration has estimated the arch could attract between 2,000 and 22,400 visitors daily and take three years to complete.
Chutkan's 33-page ruling found that plaintiffs are likely to succeed in demonstrating procedural violations by the federal government. The Justice Department had indicated construction could begin as soon as mid-November, and the Trump administration acknowledged a construction company "may be — but is not necessarily — arranging off-site preparations for construction mobilization" ahead of permit approval. The 14-day injunction provides time for further legal proceedings to continue.
Why This Matters
The 14-day injunction delays construction of a proposed memorial structure near the Lincoln Memorial and Arlington National Cemetery. The decision affects multiple stakeholder interests: the Trump administration's timeline for project execution, the judicial review of federal approval procedures, and potential outcomes for traffic and aesthetic impacts on the Washington, D.C. region. The ruling preserves opportunity for pending legal challenges to proceed while blocking immediate ground work.
