Syria sentences Assad, brother, cousin to death for war crimes

On August 11, 2026, Syria's Fourth Criminal Court in Damascus sentenced former President Bashar al-Assad and his younger brother Maher to death in absentia for crimes against humanity and war crimes committed during Syria's 14-year civil war, which claimed approximately half a million lives. Judge Fakhareddine al-Aryan presided over the landmark proceedings, the first convictions against Assad or members of his inner circle since the Assad family's regime ended in December 2024. Unlike Assad and Maher, Najib was arrested by Syria's new authorities in Latakia province in January 2025 and stood trial within Syrian jurisdiction. The court convicted him of premeditated murder, torture resulting in death, intentional killing of children under 15, and crimes against humanity linked to his role overseeing the 2011 crackdown in Daraa that sparked the initial uprising and ultimately the civil war. The court found that in March 2011, more than a dozen teenagers accused of writing anti-government graffiti on a school wall were arrested and tortured under Najib's supervision; this case became a catalyst for mass protests, which were met with brutal security force crackdowns that escalated into nationwide conflict.

The verdict represents a significant moment for Syria's transitional justice process, which began formal trials of former government officials in April 2026. In total, nine former officials received death sentences in connection with this case, including Maher al-Assad and former defense minister Fahd al-Freij. The court's finding that crimes committed by al-Assad's government in Daraa in 2011 constituted crimes against humanity underscores accountability efforts by Syria's new leadership under President Ahmed al-Sharaa, who led the rebel offensive that toppled the 54-year Assad family rule. Najib's trial, conducted with significant security measures and televised proceedings, demonstrated the new authorities' commitment to prosecuting senior regime figures, though enforcement of sentences against those in Russian exile remains uncertain.
