UK Doubles Standard Residency Period for Permanent Settlement to 10 Years
The UK government announced on 2 November 2026 that most legal migrants will need 10 years of residency to obtain permanent settlement, doubling the current five-year requirement. Exceptions apply to high earners (three years at £125,141+), public service workers, care workers, and Hong Kong British National (Overseas) holders (five years). Migrants claiming benefits or breaching rules face 20–30 year timescales; refugees follow separate pathways based on arrival method.
Quick Facts
- Standard residency period for permanent settlement doubled from 5 to 10 years
- Tiered settlement system introduced based on income and occupation

The UK government has announced comprehensive reforms to immigration rules that will significantly alter pathways to permanent settlement. Home Secretary Shabana Mahmood announced on 2 November 2026 that most legal migrants will now need to reside in the country for 10 years to obtain indefinite leave to remain (ILR), up from the current five-year standard. The reforms are intended to come into effect in 2027 and will apply to migrants already in the UK, though those who have already been granted settlement are unaffected.
The new framework introduces a tiered system based on income and occupation. High earners—those making over £125,141 annually—will qualify after three years, while people earning at least £50,271 for three of the five years before applying can still settle within five years. Specific public service workers, including doctors, nurses, teachers, and care workers who arrived before May 2025 and earned at least £25,000 per year, also retain the five-year pathway. People from Hong Kong holding British National (Overseas) status likewise qualify after five years. The government estimates the changes will generate substantial savings on benefits expenditure.
Migrants who have claimed certain benefits or breached immigration rules face extended timescales: 20 years if they work or study, 30 years if they do not. Refugees follow distinct rules: those arriving through official government schemes qualify after five years, while others must wait 10 years and either work or study. Refugees who arrived by small boat or illegal routes must wait 20 years (if employed or studying) or 30 years (if neither). All applicants must meet additional conditions including having no criminal record, speaking English to a high standard, owing no debt to the taxpayer, and earning at least £12,571 annually for at least three years.
The reforms also affect family reunification. Partners arriving together can settle simultaneously if they meet requirements; those joining later must complete the full qualifying period. Couples can combine earnings to meet a household income threshold of £25,142. Children under 18 can continue to settle with parents and are exempt from income, debt, English language, and citizenship test requirements, though they remain subject to criminal record checks. Young adults aged 18–24 who depend on family support can also settle with parents, meeting all adult requirements except individual income thresholds.
Minister Mahmood stated that the changes represent a shift in philosophy: permanent residency will be "earned rather than automatically granted" based on contributions to UK society and economy. The government indicated that the reforms can be implemented through administrative changes to existing immigration rules without requiring new legislation, allowing swift implementation once formally approved.
Why This Matters
The UK's doubling of the permanent settlement period from 5 to 10 years directly affects hundreds of thousands of migrant workers and their families already in the UK, altering timelines and conditions for accessing indefinite leave to remain. The tiered system reshapes labour market incentives (prioritizing high earners and key public service roles), family reunification pathways, and welfare eligibility. Implementation in 2027 will create immediate administrative effects on pending settlement applications and benefit calculations; migrants already in queue face retroactive application of new rules. Compliance timelines stretch to 30 years for certain populations, materially changing long-term migration planning for employers, schools, and NHS services dependent on migrant workers.
