Supreme Court blocks Trump's mail voting rule before November midterms

The U.S. Supreme Court on Monday rejected the Trump administration's attempt to impose stricter regulations on mail-in voting, upholding a lower court's temporary injunction with less than two months until the November 2026 midterm elections. In a brief, unsigned three-sentence order, the court stated that the administration "is unlikely to succeed on the merits of its challenge" to the District Court's blocking order. Only Conservative Justices Samuel Alito and Clarence Thomas dissented from the decision.

The contested rule, signed as an executive order by President Trump in March 2026, would have required states to provide the U.S. Postal Service with lists of eligible voters and mandated the use of specific barcodes on ballot envelopes. Under the plan, the USPS would have had authority to withhold mail ballots from voters not appearing on state-provided lists. The Boston-based District Court, led by Judge Indira Talwani, first blocked implementation in early September, citing insufficient time for states and election officials to comply and constitutional concerns over state authority over elections.

Justice Brett Kavanaugh, a member of the court's conservative wing, wrote a concurrence acknowledging that while the USPS may have authority to implement such rules, "state and local election officials do not have sufficient time to reasonably implement the rule before the elections." This timing rationale appeared to be the decisive factor for the majority, as numerous state and local election officials—including some Republicans—had submitted briefs warning of implementation chaos and potential mass disenfranchisement. Several states had already begun mail-in voting or purchased ballot envelopes incompatible with the new requirements.

The Trump administration framed the proposal as protecting against voter fraud, though widespread evidence of mail-in voting fraud remains limited. Critics and Democratic-led states argued the measure was an unconstitutional attempt to suppress voter turnout. Research cited by observers noted that in the 2024 election, 37 percent of Democratic voters used mail-in voting compared to 24 percent of Republican voters. With Monday's ruling, the USPS will continue delivering ballots under existing procedures, and states may proceed with planned mail-in voting operations.
